Ember & Bloom Studios Kiln Use Agreement

This Kiln Use Agreement (the "Agreement") is entered into as of [Date], by and between Earth & Sun Pottery LLC, dba Ember & Bloom Studios ("Studio"), and [Individual's Full Name] ("Maker").

1. Scope of Agreement

1.1 Purpose: This Agreement governs the terms of all kiln firings requested by Maker at Ember & Bloom Studios.

1.2 Access: This is not a public studio. Access is for drop-off and pickup only. Makers are not permitted to use equipment, tools, or materials belonging to the Studio or other individuals.

1.3 Agreement Duration: This Agreement remains on file and active for all future firings unless terminated or amended in writing.

2. Scheduling & Payment

2.1 Payment Terms: All firings must be paid in full before firing occurs. Members pay according to their membership tier on a monthly basis. Non-members pay by the cubic inch per pot. Payments must be made online before any firing is scheduled. No pieces will be loaded into the kiln unless payment has been received in full.

2.2 Firing Schedule: Firings are scheduled regularly based on kiln availability. Individual firing requests may be arranged around the regular firing schedule if space and timing permit.

2.3 Membership: Members are guaranteed up to four firings per month and receive discounted rates. Membership includes drop-off and pickup access through a unique door code but does not grant access to equipment or studio use. If a member fails to pay their monthly dues, their work will not be fired until payment is made. If payment lapses for more than two consecutive months, membership may be terminated at the Studio’s discretion.

2.4 Membership Flexibility:
Non-members (pay-as-you-go Makers) are welcome to switch to a membership tier at any time by registering online, pending availability. Similarly, members may pause or downgrade to pay-as-you-go service if preferred. All changes apply to future firings and do not retroactively affect past orders.

 

3. Drop-off, Pickup, and Shelf Use

3.1 Drop-off: Makers are responsible for labeling, transporting, and placing their work on designated shelves.

3.2 Pickup: Work must be picked up within 30 days of kiln unloading. After 30 days, unclaimed work may be discarded.

3.3 Materials Pickup: Any clay, glaze, or tools purchased online will be labeled and available on pickup shelves. These must be retrieved within 30 days of notification.

4. Technical Specifications & Requirements

4.1 Temperature Guidelines: Bisque and glaze firings are conducted at midrange temperatures. Only midrange-compatible clay and glaze will be accepted. All materials must safely withstand cone 6 glaze firings and cone 04 bisque firings.

4.2 Clay & Glaze Use: All materials must be purchased from Ember & Bloom or approved in advance. Greenware must be bone dry before the firing date. Wet work will not be fired. Makers may leave greenware to dry on the shelf at their own risk. The Studio will not monitor the drying process. Bisqueware that is glazed must be wiped clean of glaze on the bottom and at least 1/4 inch up the sides. Layered or experimental glazes must be fired on cookies provided by the Maker.

4.3 Glaze Damage & Liability: Makers will be charged a minimum of $5.00 per piece for glaze damage (e.g., drips, shelf fusion). Additional charges may apply based on severity. Repeated damage may result in revoked firing privileges.

5. Studio Policy & Conduct

5.1 No Studio Use: Makers are not permitted to use wheels, kilns, tools, glazes, or any personal equipment in the Studio. Any unauthorized use will result in immediate termination of firing privileges.

5.2 Security: The Studio may have security cameras in place for the protection of work and property.

5.3 Theft or Tampering: Any theft of clay, tools, glazes, or other materials—or tampering with another Maker’s work—will result in termination of access and potential legal action.

6. Damages & Disclaimers

6.1 Not Liable: Ember & Bloom Studios is not liable for: Cracks, breakage, warping, bloating, plucking or color changes, explosions due to improper prep or air bubbles, glaze misfires or compatibility issues, damage caused by material failures or kiln fluctuations. The Maker agrees to indemnify and hold harmless Ember & Bloom Studios and its owner from any claims, damages, or losses arising out of their use of the Studio’s firing services or materials.

6.2 Firing Decisions: The Studio reserves the right to reject any piece deemed unsafe for firing.

6.3 Kiln Repairs: Repairs and maintenance are sometimes necessary. Makers will be notified as soon as possible if a delay occurs. The Studio will make every effort to resolve the issue quickly. The Studio is not responsible for delays, but if more than three firings are missed due to repair-related delays, compensation may be considered at the Studio’s discretion.

7. Communication & Amendments

7.1 Updates: Makers will receive notifications when their firing is complete. Schedules may change with notice.

7.2 Modifications: This Agreement may be amended by the Studio at any time. Updated versions will be made available before taking effect.

8. Governing Law

This Agreement is governed by the laws of the State of Colorado.
